It may be the a-hole thing to sue, but if the guy is driving a 10 year old car, I'm guessing he doesn't have piles of cash in his mobile home for the repairs.

Is the countersuit really necessary? Geez.

Bird related observation: I saw a trumpeter swan flying overhead on my way to work this morning. Beautiful, and a real moment of zen during my commute.

Poor puppers.

Yes, all of us driving ten year old cars are just poor trailer trash. Why can't we get just get a break.

I wonder if he'd sue if it was someones kid who ran out into the road.

The trailer home part was a joke. Hell, I drive a 13 year old Geo Prizm, not that anyone is supposed to know that.

Annnnyhow, a kid is not a dog. Surprise! I'm not saying it doesn't suck, but...meh.

MPD's new slogan:
"To Protect With Courage, To Serve With Compassion."

Isn't false advertising against the law?

As the proud parent of a sweet little dog, I would be happy to take a sledge hammer to that car to finish the job.

Killing the dog was an accident, but suing the owners was just plain cruel.

I call bullshit on $1100 for a radiator for a 10 year old car.

I wonder if he'd sue if it was someones kid who ran out into the road.

I have known of a motorist who sued a cyclist they'd crashed into after the biker ran a stop sign -- and won.
»» Submitted by »»» kurtis at 9:49 AM on May 8

Not to mention the story where the robber sued the victim when he fell through her skylight and broke his leg. He won.
»» Submitted by »»» aliecat at 9:51 AM on May 8

alie- it also for lost wages and court fees.
»» Submitted by »»» kc! at 9:52 AM on May 8

kc, I thought people couldn't sue for court fees anymore?
»» Submitted by »»» aliecat at 9:53 AM on May 8

Bob, the trumpet swans have been flying over my house for the last few weeks as they fly to Phalen. They are awesome birds.

Re dog: It's a total bummer to lose a pet, but I think the driver has legal ground to stand on. Ethically, it seems a little cold to sue someone after running over their pet.

»» Submitted by »»» JACC at 9:55 AM on May 8

That's just what the article said. The dog owner is countersuing for court fees, among other things, so it must be allowed.

Re: MPD

$49,137 for a slogan? It seems to me, with all the bitching MPD does about not having enough cops that money should have went towards another officer.

And can a market strategy really "increase the cultural diversity of the department's work force."

What are they going to do? Have bingo night? Margarita night?

Where's are the marketing MNspeakers?

I know -- but the emotional dog owner side of me just doesn't care...

(swings sledge hammer again)

BAM!
»» Submitted by »»» justpbob at 10:02 AM on May 8

I don't see those as the same, Aliecat. Motorists should have every right to sue people who damage their car through negligence or lawlessness. A cyclist isn't immune to the law just because they're physically vulnerable. If you run a red light and cause an accident, you are every bit as legally accountable as a car that does the same thing.either. I don't see this as one of those ridiculous law suits. Incidentally, the main reason for the lawsuit was to establish that the cyclist caused the accident to protect the motorist from lawsuits going the other way.
»» Submitted by »»» kurtis at 10:08 AM on May 8

I think the emotional dog owner side of you should be outraged that the dog was let to run into the street, Bob.
»» Submitted by »»» kurtis at 10:10 AM on May 8

I think joyride made the kid arguement...I have no feelings either way on the subject. Seems like both parties are equal assholes in the fight.
»» Submitted by »»» aliecat at 10:12 AM on May 8

Sounds like he darted out the door and ran into the street, kurtis. The owners said they never let little Fester off the leash in their yard.

»» Submitted by »»» justpbob at 10:24 AM on May 8

Am I missing something?
wouldn't the driver's insurance cover that damage?

I'd love to see the link about the burgalar winning the lawsuit....

Sounds like he darted out the door and ran into the street, kurtis.

So that makes it the motorist's fault?

Our cat Bertie bolts sometimes. It wouldn't make us irresponsible pet owners if he were hit by a car, but I would sure as hell take responsibility for an accident instead of taking a sledgehammer to the hapless bastard who hit him.
»» Submitted by »»» kurtis at 10:29 AM on May 8

Baker, I'll look around, it was several years ago in the UK.
»» Submitted by »»» aliecat at 10:29 AM on May 8

In the legal sense, the owners of the dog are 100% liable for the damage done to the guy's car.

The countersuit is ridiculous. The dog's owners are the real assholes here, and suing for a dog's value means it's merely a piece of property to them, so it makes the original guy look a lot less like an asshole. Not to mention that in no way could it be construed that it's somehow this guy's fault their animal decided to make a run for it.

On another tangent, fuck people who buy dogs from breeders. Same goes for cats. So many animals in shelters yet you HAVE to buy the dog that supports your vanity habit.

He'd still have to pay his deductible, though.
»» Submitted by »»» joyride at 10:31 AM on May 8

wouldn't the driver's insurance cover that damage?

He might have had collision-only insurance... or maybe he doesn't want to pay the deductible and his premiums going up. Who knows? It doesn't matter. He's under no obligation to just suck it up and pay for the damages if he doesn't want to.
»» Submitted by »»» kurtis at 10:31 AM on May 8

He probably only has liability....?

In any case, making a claim against your insurance these days is just asking for a monumental rate increase. It's better to go after other sources of payment first if there's any suggestion of another party being at fault. Blame the insurance companies for that.

I don't tell you how to spend your money nor do I suggest you get fucked because our society is irresponsible when it comes to pets and as a result the pounds are full.

I love dobermans and I wanted two, so I bought them from a very small reputible breeder.

Do you know how long I'd have to wait to find one, let alone two, doberman puppies in pound?
Do you know how awesome it is to raise pets that are actual siblings?

I did get our cat from the pound and I donate to the humane society every year.

Wow, since when is driving a 10 year old car uncool? LOL

I have never had a car that is less than 10 years old. I hope to drive mine till 20-30 years.

Of course I practically live in a trailor park.... Do I forfeit the "white-trash" label if I have a masters degree?

Oh and I will avoid putting ethanol in it at all costs. Except of course for the ethanol that the government forces me to put in there.

Where is my Plug-in Hybrid Damnit!!!!!!
